criteria for leave

i have found am ambiguity on the institite's website regarding the leave allowed during articleship.

i have read the training guide which is there under the students section on the website, according to which as per regulation 59 in appendix VII, an article is eligible to take 1/6th of the actual no. of days worked.

but on referring to regulation 59 under regulatory guidelines under the same students section, an article is eligible to take 1/7th of the actual no. of days worked.

one of my friend has also got letter for excess leave of 5 days and he has shown the leave of 140 days. this means that institute is still following the criteria of 1/7th.

whats the exact regulation. any idea?

Calculation of leave

Total no. of days served       (365*3)

Less: Leave taken other than weekly holidays

Actual period served

1/6 th of above

Permitted leave

anything above permitted leave will attract reregistration of articles.

as per the above claculation the total leave allowed should be around 182 days (365*3= 1095/6=182.5) However as per our Institute only 135 days leave is permissible. Can you explain why?

where is this written that only 135 days is allowed. if this is there then that means again institute is considering criteria of 1/7th.

 I read two post on the forum and it was mentioned there that the total leave allowed is 135 days. 

And the same fact is apparent from the letter received by your friend from the CA Institute.

 

 

An articled clerk is eligible to 1/7th of the total articleship period served by him upto the date of the examination, excluding any leave already taken.

The formula for the calculation of the same is;

Let the articleship period actually served be 'x'.

Therefore, 'x' + 1/7x + Casual leave taken = 365 x 3 = 1095 days

Solve for 'x' and we get the period served upto the date of the examination,

then derive 1/7 of 'x' and we get the total leave eligibility.

These calculations are as per regulation 59 the ACT.

@ Mr. Prathik Gupta,

        As per the method mention by you above the total permissible leave shall be more than 900 days (after deducting 60 days leave allowed by Institute for Prepration of Exams.)

 

I dont understand the method used by you for arriving at that number, would be helpgul if you could share it here.

    I wud like to correct that actually x= 905 and therefore 1/7 x wud be 129.

can anyone tell me is the credits earned by me for working on saturdays and sundays be netted woth the leave taken by me ....???
