Hi friends,

In the institute's student newsletter president as well as vice precident have published their full introductory bio data including the name of their firm and the companies in which they hold directorships. this includes statement like their expetise in various fields also.

my question is that is it not a voilation of clause 6 of part 1 of schdule 1 of the CA act 1949 which prohibits soliciting clients and prospective clients?

Hi sidharth,

As per Rule the person to be appointed as auditor should not hold any disqualifications provided in sec 226 but provided that it doest affect his client office regards his independence, etc.... But their expertise in various fields doesnt affect.... If the disqualifications abundantly reflected then the auditor becomes disqualified...

Agree with Karthika.

Also Companies Act, 1956 provide enough provisions to ensure the independence of Statutory Auditors.

Good Question!
