Dear Sir,

Need your opinion on the below -

If a company listed in MCA has a litigation matter in court against them. To change Director in current scenario do we need to take special permission from any authorized person (in MCA or CLB)

Kindly revert back at the earliest and oblige.

Hi, No permission required from MCA or any authority. However the litigation will be continued on the Director in whose name the suit is filed. Also if there is any default on the part of the Director in the Compliance of any provision of the Companies Act, or any applicable Act, the Director will be responsible even after his cessation from Directorship if the default has been made during his tenure.
