Adjustment of Refund

I have paid requisite tax for AY 2009-10, 2010-11, 2011-12 and filed ITR with concerned ITO. But ITO sent demand notice which I have complied then . Now CPC is raising the same. Inspite of my disagree with it on line , CPC is deducting the same with fine from my refund of AY 2018-19. Is this a reward for paying tax in time by way of TDS and self assessment tax? Please advice me what can I do to get back my refund without being adjusted.

Once outstanding demand is paid, interest demand for the delayed payment is raised; which you cannot disagree. It that be the case, no other solution; otherwise file grievance.

How outstanding comes as I have paid the tax in time. Here outstanding is raised and adjusted against my refund. For no fault of mine i am paying the same tax two times, one paid when it is due and the same is raised as demand and adjusted against refunded. what can I do for this anamolly. please suggest.

You should have raised the grievance as & when the order was issued. When no objection raised within 30 days, its presumed to be acceptable. Still try to file rectification request with proof of tax paid and for any mismatch between the tax credit as per form 26AS and assessment order.

May I file rectification with ITO concerned with proof again as ITR is filed with ITO concerned. I think my Deducting Officer has not deposited in time as 26AS is not showing the TDS of the concerned years. For no fault of mine I am suffering . What can done , please suggest me the way out.

If your TDS is not deposited and as such not reflected in form 26AS, even commissioner will not be able to help you. You should better get the TDS refunded from your deductor/s.

Even if the TDS is deposited but it is not uploaded by service provider corrector what can be done as the service provider has stopped his services in my town.

As such its not mistake of ITD. Get TDS reflected in form 26AS and ask for its credit. Without that its all in vain.
