sir i read your following query answer. http://www.caclubindia.com/experts/service-tax-paid-but-invoice-was-cancelled-798995.asp but this rule talks about only if service not provided but tax paid. What should be the treatment of tax when i have provided service but because of commercial reason party has not paid for these bills at all.

  • A B B says : Service Tax On import of services
Namste Sir, I read your comment dated 23rd Nov 2011 regarding payment of service tax on import of services. As you mentioned that we can take set off through CENVAT credit available for service tax liability for import of services. However as per Rule 5 (Import of service rules) states that " The taxable services provided from outside India and received in India shall not be treated as output services for the purpose of availing credit of duty of excise paid on any input or service tax paid on any input services under CENVAT Credit Rules, 2004. "
