    From 20.06.2006 to 31.03.2010 1. Composition Scheme U/s 42 (3)- Under this scheme developer has to pay 5% tax on the agreement value. Land deduction is not available. Input tax credit is available subject to the reduction of 4 per cent.     Dear Sir, I have gone through your answered query regarding service tax on rent - http://www.caclubindia.com/experts/service-tax-on-electricity-bill-paid-by-tenants-819245.asp#.UCINYPYgdCQ However I have a question. As per Section 12 of The Electricity Act, 2003 the Owner cannot bill the tenant for electricity charges. He can only ask for reimbursement. If this passing of electricity has to be billed, it should be after receiving permission from appropriate authority for eg. Central Electricity Regulatory Commission etc. Hence the owner is not providing the Service for electricity and therefore Service tax cannot be charged. If Service tax is charged then will this service be deemed as illegal in the eyes of The Electricity act, 2003. Sir, I am a layman and not an expert. But since this service is provided by my organisation, I am deeply concerned. Kindly send your views on the above subject. Thanks and Regards, Amol

    Sir, Suppose there are three parties A,B &C and MrB has sold goods purchased from MrA directly to MrC without taking their delivery now the bill is issued by Mr A in the name of MrB but MrC name is there in the Consignees name and Mr B has issued only commercial invoice to MrC.Now my query is that whether Mr C can avail credit of excise duty paid on such goods based on transporters invoice. Please guide on the above matter
