CBIC Bars Provisional GST Refunds for Pan Masala, Tobacco and Essential Oils from 1st October 2025

The Ministry of Finance has issued Notification No. 14/2025 - Central Tax (S.O. 4204(E)), introducing important restrictions on provisional refunds under the Goods and Services Tax (GST) framework. Acting on the recommendations of the GST Council, the government has notified categories of taxpayers who will no longer be eligible for provisional GST refunds under Section 54(6) of the CGST Act, 2017. The new rules will come into force on October 1, 2025.

Key Highlights of the Notification

No Refund Without Aadhaar Authentication

  • Any registered taxpayer who has not completed Aadhaar authentication under Rule 10B of the CGST Rules, 2017, will not be allowed provisional refunds.

Restricted Goods Categories

Businesses dealing in the following goods will also be excluded from the provisional refund facility:

  • Areca nuts (Chapter 0802 80)
  • Pan masala (Heading 2106 90 20)
  • Tobacco and manufactured substitutes (Chapter 24)
  • Essential oils (Heading 3301)

Legal Clarification

  • For interpretation, tariff item, heading, sub-heading, and chapter references are as per the First Schedule to the Customs Tariff Act, 1975.
  • The notification clarifies that Section and Chapter Notes and General Explanatory Notes of the Tariff Act will also apply for proper classification.

Impact on Businesses

  • Tobacco, pan masala, and areca nut traders are expected to face stricter compliance as they will no longer enjoy provisional refunds.
  • Exporters dealing in essential oils will also need to adjust cash flow planning, since refunds can only be claimed after final verification.
  • For general taxpayers, Aadhaar authentication has become a critical compliance requirement for refund eligibility.

Industry Reactions

Tax professionals see this move as part of the government's ongoing efforts to curb tax evasion and fake refund claims, especially in sectors prone to misuse. While some industries may face liquidity challenges, experts believe the notification strengthens the credibility of the GST refund system.
