Quick Summary
This discussion explores whether a business involved in the purchase and sale of old vehicles can be treated as a trading business and filed under Section 44AD of the income tax return. While outright purchase and sales with ownership transfer generally allow for presumptive assessment, the specifics of transactions where ownership isn't immediately transferred are debated. The conversation also touches upon whether such transactions could be considered short-term capital gains and clarifies that this type of business is not typically eligible for Section 44AD.
Sir I further requested that I purchased the vehicle and paid the final amount to owner of the vehicle but not transfer in my name and as and when I found the good pay master customer I sold the vehicle and make the agreement of transfer of ownership, whereas both the amount of sale and purchase has been credited in my account.Sir I also want to know that can this kind of transaction comes under the short term capital gains.please guide me.Thanks
