Verifying LTA claims (for train e-tickets) and HRA claims

Hi All,

I am in the Finance department of an IT company.
Last year, many of my company's employees submitted HRA and LTA claims for tax deductions.

For LTA, many submitted e-tickets for train travel.
As train e-ticket (booked online through IRCTC) is purely soft copy, there is no concept of original ticket copy.
The tickets have to printed by the ticket owner himself/herself.

So it is very much possible that some employees booked tickets online and cancelled them
soon without travelling and thus claimed LTA illegally by printing the tickets before cancelling them
and submitting them for LTA claim.

As far as I know,in case of online tickets, it is not possible to know whether a ticket was
used for travel or not - because PNR no. gets recycled by Railways after few days of cancellation.

In case of Air Tickets, we insist on employees providing boarding passes as proof of actual travel.
But for train e-tickets, I am facing difficulty in verifying the LTA claims.
Is there any way I can verify the LTA claims made by employees so as to discourage employees from
following this malpractice?

Similarly, many employees also submitted rent receipts and rent agreements to claim HRA.
I know from inside sources that many employees also submit fake rent receipts and rent agreements
to claim higher HRA (although they pay much lower actual rent) so as to get higher tax benefits.

Is there any way I can verify such bogus HRA claims so as to discourage employees from
following this malpractice?

Ask for credit card statements or bank account statements from which e-ticket is paid.It should be in employees' name. Ask for statements for at least from payment date for ticket to upto 90 days beyond the date of travel and if you see any irctc refunds, ask them to prove the refund is not pertaining to that travel. Normally 90 days is what it takes if journey is not performed and ticket is surrendered after chart preparation. Before chart preperation, refund takes 3 days from cancellation and it will come to the same account from where it is paid. If he pays by credit card, take the credit card statements. If he used net banking, take the net banking statement. Ask him to open his IRCTC accound and check the refund status and online TR (for those after charting). The IRCTS has the history and you can ask him to login to his account so that you can check.

But Many People book tickets from Agents and if that employee says that i have paid Cash to the Agent then how you are going to check that??

Dear Rohit,

As an employer, you should know your responsibilities cast upon by income tax department. You can not be the detective to certify that rent paid or the travel tickets are ingenuine. What you need to make sure that proofs are submitted by employees and same (within normal circumstances) appear genuine. Means you have no reason to doubt its genuiness.

For HRA - You are required to maintain the rent receipt submitted by employees. In case, total rent paid during the FY exceeds Rs. 1 lacs, you also need to take PAN of landlord. As employer, the address mentioned in the rent receipt should be same as updated in company records. For any rent receipt > Rs. 5000, Revenue stamp should have been affixed.

In case, all above are OK, your responsibility as employer is met as far as income tax is concerned.

 

For LTA- employee should submit the travel summary alongwith copy of tickets. He must be on leave from company during that tenure. There should not be any information available within your source that employee was in company city and has not travelled.

 

In case, above seems OK, there should be no issue from income tax department.

If you have booked your ticket online then, you can login to your IRCTC account and from your booking history, you can claim for refund of particular ticket and in case you have you booked from PRS counter then you have to do it manually from the nearby reservation counter.
