Unclaimed TDS of AY 2017-18

Please guide, how can one claim TDS relating to AY 2017-18 amounting to Rs. 1197, haven't filled Return for AY 2017-18. Is it possible to claim unclaimed TDS in return of AY 2018-19 for individual.

No... There is no options for unclaimed TDS for previous AYs except c/f in previous ITR...

File condonation request for delay in filling return for AY 2017-18, with your Jurisdictional ITO/CIT. If approved, you can file return to claim refund.

1) Give application to your ITO to file AY 2017-18 u/s 119(2)(b). (see Circular no 9 2015.).

2) Once permission is granted you can file online under above clause. Login -->my account-->service request.

3) Take income and TDS both and any other income in return

Dear All.,

Condonation delay will be applicable if assessee will be file AY 17-18 ITR. Can't claim the TDS amount in AY 18-19...

For all members,
Assese haven't filed any return till date, as his income does not exceed exemption limit ( he is a b.com student and teaching part time), TDS was deducted by bank on small FD made by assesee from savings and some tuition income. now the assese wants to claim TDS deducted by bank, but as the time for filling return for Ay 17-18 has lapsed, So assese wants to know any way out to claim such amount by filling return for AY 18-19

Dear Vikram.,

First of as per your query and detail no more options for claim previous AY TDS in CY return...

But,
If he is file condonation delay request for filing ITR AY 17-18 then he can file ITR for AY 17-18. In case he can't will be file AY 17-18 ITR then no more other way for claim the TDS amount...

IMHO

119(2)(b) is about refund issues . All genuine refund cases will be entertained including filing return and claiming refund. My case I had filed return u/s 119(2)(b) for some TDS appeared after two years. I filed application to ITO - he said file under different section .(CIT has powers to accept any refund of unclaimed TDS appearing late) and not under 119(2)(b). He took me to CIT also that time.

What is your exact standing this query...?

The unclaimed TDS (ay 17-18) can claim (ay 18-19) or not...?
if yes then how...?

1) Vikram you can claim TDS of 1197 pertaining to AY 2017-18 by filing AY 2017-18. only.

2) For filing 2017-18 give applicartion to your ITO (draft attached here) . You can file return only if you get permission which you will get 99 percent.

3) You cannot claim TDS appearing in FY2016-17 (AY 2017-18) in AY 2018-19 unless you file AY 2017-18 and C/F your TDS (as per Notification 28 dated 16/03/20090 ) and then B/F in return of AY 2018-19
