I WANT TO KNOW WHETHER AN EMPLOYER CAN FILE TDS RETURN FOR A.Y. 2011-12 AS HE FORGOT TO FILE THE SAME IN THAT YEAR BUT TDS WAS PAID .
NOW AS TDS RETURN IS NOT FILED HIS EMPLOEES GETTING NOTICE FROM IT DEPARTMENT.
AS THEY HAVE CLAIMED THE TDS IN THEIR IT RETURNS
SO IF HE FILE TDS RETURN NOW WHETHER HE WILL BE PENALISED ?
Manoj i have question for you - Wether your employer has filled a TDS return earlier than 2011-12,if yes then the income tax is going to send a notice .If no then go ahead with the return but might be that the Traces Ghaziabad might send a demand notice as well as penalty.
But in your case the TDS amount has already been paid therefore the ITO might be lenient and waive off such penalty.
@ Pratik employee had filled return for 2012-13, 2013-14 but demand is for 2011-12 which is not filled but TDS is paid so my question is whether late payment will be charged as 200 wef 1.07.2012
