Tds rate on special software development as per agreement

Sir,

Please tell me the rate at which the tds on special software development as per agreement  is to deducted. As it is assigned as per the mutually agreed terms & conditions, I have a doubt whether it should be under 194C or 194J.

Please advice me fast..

I think it comes under 194J, Let's see others view also.

If the software is designed specially for your company then TDS will be u/s 194 J
