Quick Summary
This discussion clarifies the TDS rate applicable when a non-resident sells immovable property without a PAN. The standard rate for long-term capital gains is 20%, but if the non-resident lacks a PAN, the 'rate in force' applies, which is 30% under Section 195. This can lead to a short payment if only 20% was deducted, as shown on TRACES when filing Form 27Q.

Yes as PAN is not declared so for that higher rate has been charged
U/s 195
Any payment made to NRi , TDS is required to be as per 195. In the absence of PAN , rate in force is to be charged.
Rates in force is 20 percent (Long term capital loan)
