Tds query??

Dear All,

Assesse has filed his return u/s Sec 44AD in the A.Y. 2011-12, being income more than 8% of the gross receipts.

However, in the current year the income shall be more than the 8% of the gross receipts , and hence falls under the purview of 44AB.

Now, what about the TDS liability in the current year when the assesse falls under Sec 44AB????

In case, the assesse comes under the normal provisions for filing the return in the current year (i.e not under 44AD) then what about the TDS liability??

Plz address the query asap as the TDS needs to be dedeucted in the last quarter.

TDS has nothing to do with turnover of the company, if a company is liable to pay tds even in the turnover of 20 lakh than they should register for tan and deduct tds. for Eg. An individual hire a shop to run a shop and have to pay rent of rs.30,000 per month than he is liable to deduct the tds before making payment. so formation and turnover doesnt matter.

Since individual was subjected to Tax Audit in F.Y. 2010-11 so he would be liable to deduct tax at source in F.Y. 2011-12.

If individual fall under 44 AB cases then only individual has to deduct tds.
