Tds on immovable property purchase

I have purchased a flat along with my wife and the booking of flat was done in Jan 16. Thereafter we are paying money from our own source according to slab wise.  In Nov16 we have entered into agreement with builder and registered the same and by the time we have paid almost 90% amt of consideration of 63 lacs.

we have paid the Tds of Rs 63000 in dec 16 as we have enterred into agreement and we are going to buy the flat.

My query is whether there is any penalty as i have not deduct tds on installement paid but at the same time i was not confident of buying flat .

Technically you need to deduct the TDS on each advance payment. But practically you have remitted the TDS on execution of the agreement so there is no loss of revenue. At the most if any issue has been raised than govt can demand interest as well as late fees as applicable based on the advance instalments paid by you since Jan 2016.
