Dear Sir,
We are sending tyres to a testing lab in USA. As per new TDS law I want to know whether the USA company needs to have PAN in India. Also are we suppose to deduct TDS on the testing invoice. If so in which catagory ! If not then which law applies.

Testing charges attracts to deduction of TDS you need to check what rates are applicable to USA by visiting on www.incometaxindia.gov.in or search DTAA (Double Taxation Avoidance Agreement) agreement with USA and check the same that which rates are applicable.
