One of my friends gets his monthly pension from his employers who deduct TDS amounting to Rs.3750 per month which is annually Rs.45000. For the Financial Year 2012-13, the employers have not deposited TDS in Govt. Account and therefore the Form 26 AS does not reflect any amount. How should the assessee proceed in the circumstances. The firm has run into financial difficulties and has defaulted in depositing TDS in Govt a/c and are not issuing Form 16.  How should he proceed.

In this case you should claim refund of TDS on the basis of Pension Slip.

Please Refer Sec.199 of IT Act,1961
