One of my friends gets his monthly pension from his employers who deduct TDS amounting to Rs.3750 per month which is annually Rs.45000.  For the Financial Year 2012-13, the employers have not deposited TDS in Govt. Account and therefore the Form 26 AS does not reflect any amount.  How should the assessee proceed in the circumstances. The firm has got into financial difficulties and has defaulted in depositing TDS in Govt A/c.  The firm is not forthcoming in issuing Form 16 despite several reminders.  How should we proceed.

Hi

 

FIrst of all he should collect Form 16 from employer, if TDS is shown in form 16 on the basis of the same your friend can claim TDS credit on the basis of the same.

 

Also you can compell employer to deposit TDS (if not deposited) & e-file return to get Tax Credit of the same.
