Tax on unpaid salary

TDS 1010 views 1 replies

Is it possible to pay taxes on receipt basis for a salaried employee?

My reason for asking this question is that, I have not received my salary for the month of Feb' 2012 and March 2012 till 31st March 2012. So is it possible to pay the taxes on basis of receipt, this will help me save some money on taxes because the tax range increase of 8L to 10L for 20% slab in 2013. My employer is booking the pending salary into company account on accural basis and will deduct the TDS when they will pay me the salary.

Is there any option available for me to ask them to deduct the TDS on receipt basis and not on accural basis?

5- Chargeability of salary: - under section 15 of income tax act, salary is taxable on due basis or receipt basis whichever is earlier. Whenever he gets salary of more than 12 months in one previous year he should make a claim of relief under section 89 of income tax act.
