We are running a consultancy but we are registered for S.tax, however our turn over is less than 10L
we have collected the Stax and we re-paid also all the taxes which we have collected . but my queries here are as follows
1. if i stop collecting the service tax will i need to surrender the Stax to govt?
or
2. i need to just show that NIL on the Stax since i have not collected any
kindly help us with the queries.

Dear Shruti,
If you have collected ST, even though you were not required to do so, you have to pay the same to the Govt. which you have rightly done.
Now, you can continue to file nil returns for service tax. It is advisable not to surrender the same since, there may be certain activities coming under the reverse charge mechanism, wherein you may have to make the payments

You are welcome Shruti,
Normally, the Service provider (SP) charges ST to the Receiver(SR) and pays the same to the Govt.
In RCM, the SP need not charge anything. But the SR has to directly pay the ST amount to the Govt.
There is a list of services given , wherein the RCM applies.
I can email you the list if you want so.
