Service Tax Penalty

In case of Late Filing of Service Tax return, the penalty is to be paid via DD along with Return In whose favour should the DD be prepared? Thanks in advance

It can be paid. There is a separate code in challan for paying penalty even in cases of e-payment

Dear Yash,

There is no need of complicating issues by preparing a DD, in GAR - 7 there is a provision made for interest payment due to late filling to Service Tax, you can do the same. However there will be a code to write for Interest, which will be present behind the Challan.

hi, if the penalty is paid the it should be charged from profit and loss a/c or directly in service tax what will be the entry if in service tax directly.

We are in the business of Transportation of Buses. We did not collected and deposited service tax on rent earned from Bus Stnds. we also hire on Contarct basis drivers from outsiurcing company and pay service tax to them. Can we take the benefit of this payment agasit the amt of rent. How to caluclate inetrest and penality for not depositing return and tax.

Choose your Penality code for your Service at the back of the GAR 7 challan. Each Service has Different Penality codes or Visit this website https://servicetaxdelhi.gov.in/listofservices.asp.
