1. What is the eligiblie amount in deduction of Service tax on rent?

2. What is the % to be applied for the  financial year 2009-10?

Are u asking for 2009-10 or 2010-11

There is a doubt whether ST on rent is liable at all.

Assuming liability the deduction available is only in respect of municpal taxes paid.

Cenvat credit of input services could be utilised to pay the ST .

Dear all,

My query whether Service tax on rent should be paid now whichever has not been paid before considering the Delhi High Court decision? As we are getting Dept notices to pay the service tax which has not been paid with interest @ 13% p.a.?

YES SERVICE TAX ON RENT SHOULD BE PAID. WE ALSO CONSIDERED CONTINGENT LIABILITY IN BALANCE SHEET FOR THE COMPANIES WHO EITHER NOT PAID SERVICE TAX LIBILITY ARISE BEFORE CONSIDERING DELHI HIGH COURT DECISION OR NOT CREATE LAIBILITY AS ON 31.3.2010 IN THE BOOKS OF ACCOUNTS
