One of my friend bought new flat which is fully constructed. Builder is demanding for the payment extra amount on behalf of service tax. But as per the rule service tax is payable only if the property is under construction.
Will you please tell me, is he liable for the payment of service tax to builder ??
No residential unit or as a part of residential complex is exempted from service tax by virtue of notification no.25/2012-Service Tax. So no need to pay tax amount to builder.
