Service tax liability for rent

I am a partner in partnership Firm 'A' which provide services of more than 10 lakh and covered under ST. I am also a co-owner in commercial building which is given on rent whose total yearly rent is less than 10 lakh. I want to know whether my rent income is covered under Service tax ?

Renting of residential dwelling of a property for residential purpose is not chargeable under service tax.However, renting of a property for COMMERCIAL USE is chargeable under ST, therefore service tax is required to be collected @ 14.5% on the total rent payable(Note :- w.e.f 15-Nov-2015 St rate has been increased from 14% to 14.5%)

Dear Harish Its only covered if rent is more than 10 lakh. But my rent is less than 10 lakh and other thing is i am partner in firm which is covered under ST. So, i am liable to collect ST on rent or not ?

ST is liable to person. It is PAN based.

As the partnership is different from you individually, unitl your taxable services exceed Rs. 10 lakhs in the pr yr , you are eligible to exemption upto Rs. 10 laksh this year.

If the taxable services provided by a person is more than 10 lakhs in the previous, the person is required to be registered under the service tax unless and otherwise he is registered under SSP(small service provider). If a person who is registered under the ST is required to collect service tax in case of renting of a COMMERCIAL PROPERTY, NEVERTHELESS the rent is not more than 10lakhs p.a.

See partenership firm and partner two things are different So if your rent income is more than 10 lacs than and than only you are liable to pay service tax.
