SERVICE TAX IN CASE OF TRADER WHO ALSO PROVIDES SERVICES

If trader who is also provides services ,can he claim cenvat that is input service tax on invoices eg telephone which is used for both that is trading business as well as consultancy bus.?pls reply its urgent

ansewer is YES.

Rule 6 (3) doe snot bar the services used commonly along with trading. However the input services used exclusively for trading would not be admissible. As far as the common services, it maybe advisable ( not mandatory) to apportion the same and reverse that component if disputes are to be avoided.
