Service tax in case of job work

432 views 2 replies

I am an exporter of leather gloves and send them on job work basis (contract basis). They come back in semi finished state. The job worker does not show service tax in the bill. I have deducted TDS u/s 194C on all the payments made to the job worker.

Am I liable to pay Service tax on the bill raised by the contractor? Please also send the link of the applicable Section.

as far as my understanding goes, you would be liable to pay excise duty on your manufacturing process. and according to sec. 65B(40) of finance act, 1994, processes chargeable to excise duty, where such process amounts to manufacture is not liable for service tax because it is covered in the negative list.
Yes I concur with Mr.Tribhuvan Aditya Singh
