Service tax as company or as individual?

Hello Forum Members - I am an IT professional and am starting to provide paid software solutions to online buyers. I would like to give a more professional name to my services (like XYZ Solutions) instead of my own name and register for service tax with that name. Do I need to register a proprietorship to get service tax registration in that name? I am living in a rented house so I am concerned that I may not be able to provide a fixed office address, how can professionals who are always moving from client to client get service tax without an office address?

You can take service tax registration in the name of the firm of your choice. You need to apply & sign the ST applicaiton ST-1 as a proprietor of that firm. You will be required to give the address proof of the premises where you would be keeping records and issuing bills to your clients/customers. Rent agreement is a valid proof of address.

Many thanks Mr.Manoj. Just one query - my rent agreement of my house is in my own name, can I still obtain service tax regn in a different name or should I rewrite the rental agreement? Are you based in Hyderabad?

A proprietor and a proprietoship firm is one and same. A proprietorship firm has no seperate legal existance. You need not rewrite your rent agreement. You can simply sign the copy of rent agreement by putting the rubber stamp of the name of the proprietorship firm.
