ser.tax payable on rent -included

    example 1,00,000 recvd rent  client not paid service tax
  officials  demand   to pay serv.tax - recvd rent  so pay service tax.
is it right  pls advice.
  my queary   recvd amount 1,00,000 on this  tax was 12360
    or  included service tax  89,000  on this   tax was   11000
      which  is right one(ser.tax not recvd case)  pls  advice forum friends.

If you provide any taxable service, then you are liable to pay Service Tax.Service Tax is calculated on the full and actual amount of revenue (value of taxable service)earned through providing of taxable service.
Service Tax amount is a separate component and hence usually computed on the amount received.So, depending upon your information, rent of Rs.1,00,000 received by you will be EXCLUDING service tax.
So, Service tax amount payable would be Rs.12,360.00 (Rs.1,00,000 * 12.36%).If your client has not paid or refuses to pay the service tax amount, then you may have to pay it out of your pocket.

If Rs.1,00,000.00 is excluding service tax, then you can reduce your rental income to show that this 1 lakh received is including service tax of Rs.11,000.00 (Rs.89,000 * 12.36%).This can be done, no problem at all. But check for the exemption limit applicable for service tax as your income be within such limit, if you are about to show less rent received. Any ways, the last point may be irrelevant for you.Dont worry about that sir.
This 100000 includes the ST Portion,since you didn't collect the ST. So the amt to be paid to Service Tax Department is 100000/112.36*12.36%

Can the same logic be applied to Godown Rent as well, specially if the godown owners are giving rough reciepts without paying service tax, can we show the amount as inclusive of service tax and settle the same accordingly?

Whether the godown owners have first obtained service tax registration. If so, request a copy of the same.  

As per service tax rules, every service tax assesee should raise a proper bill/invoce within 14 days of providing service.

If i raise a tax  invoice and charge service tax

 and client doest not pay the amount of invoice in that case

do i have  to pay service tax  charged on the invoice  from my pocket.

Let us assume that you have raised an invoice for a value of Rs.10,000/- and charged service tax of Rs.1,236/-. 

If you are clinet pay no amount there is no liability on you.

If he pays an amount of Rs.5,000/- only,  treat the realised amount as cum-tax and pay  service tax.

BUT WHY WASTE SO MUCH VALUABLE FORUM SPACE?

we have receiving debit note for rent for office with service tax @ 12.36%,

can any one suggest me, debit note is valid for it, or we ask for proper invoice for rent with service tax,

please suggest me to my id hasmukhpatel_in @ yahoo.co.in

If you are going to avail cenvat credit please demand and obtain a proper invoice or bill indicating their service tax registration number.
