Hi Guys,

 

If you refer Section 80D of Income Tax Act, there it is mentioned that premium must be paid in any mode other than Cash and it must be paid OUT OF INCOME CHARGEABLE TO TAX.

 

Now suppose if an assessee has paid Mediclaim premium through cheque but not from his bank account but from his father's bank account. In this case it is not been paid from his income chargeable to tax. So will he get the benefit of Sec. 80D or his father will get?

The section says that the payment has to be made by the assessee by any mode other than cash...so here father can claim the exemption but son cannot..

For an assesee to claim benifit u/s 80 has to make payment & payment from fathers's bank acc does not mean he has paid so son cant clain any deduction.
