For sale return right now no intimation is required with Annexure-51 to the range office.. Party neither issue own excise invoice nor sending our excise invoice for returning the materials , just giving D.C mentioning our exciose invoce no. & date . Right now I know that there is no bar that Duplicate for transport copy is only require to take credit..

In this case If party mention of our excise invoice reference,then if i attach that excise invoice (photo copy, which is kept with us as office copy) is this sufficiant to take cenvat credit on the strength of party's delivery challan (D.C) ?

@ Amitabha Mukherjee, If its a sale return, then the entire set of Invoice along with the Original and Duplicate for transporter copy should be returned back. It will be better, if you give the intimation of the same to your range officer. Also you need to keep special track of the returned goods in your stock and subsequent sale of the same. You cannot claim back the cenvat credit on the D.C. of the party. It will lead to problem at the time of Excise Audit. If can avail\reverse the cenvat credit only on your Dupilcate for Transporter's copy.

thanks Mr. Anandan for sharing your views, Sometimes it is not possible for the party to send all the doc. as they are not returning entire materials, partial mats they are returning. In this state not possible to send the doc. , but they can raise their invoice , but some party averting this system . merely a dc they are raising and sending the same as sale return reffering our excise inv. no and date. all the formalities we are maintaining but for nothing we are loosing cenvat
