Salary returned tds issue

A person had recieved an amount as salary last F.Y on which TDS has been deducted.ITR has been filed.

Now in august company is asking him to return back the amount GROSS AMT they are asking to pay back....which is incorrect.

Please tell how it should be dealt with....and how refund should be claimed on tds which has got deducted on such income

Dear Richa,

If company has paid excess salary to the person then following options are available :

1. Ask to Company,  adjust excess salary in next financial year or

2. If you want to reimburse execess salary to the company then first take letter from company stating that excess salary had been paid by company in Last financial year & arrange revised form 16. Then file revise ITR. You will get your refund.

YES I TOTALLY AGREE WITH PRAGNESH SITAPARA.

AS HE SAID THE ASSESSE HAS TO GET THE REVISED FORM 16 FROM THE EMPLOYER.
