Reverse charge on advocate services
Dear all.. While doing journal vouching of a company, i found that the company has passed entry for payment to an advocate who filed complaints for the company in court and also sales return..all d amounts were in excess of 20000.. so i raised a querry why company is nt passing entry for reverse charge for which they remarked dat d lawyer has nt represented comp in any hearing or appeal..plz tel me if reverse charge is aplicable in dis case..

In this case whether Advocate represents company before tribunal is irrelevant.. company received legal services for filing of complaints in court and has paid legal charges to Advocate, which attracts Service tax under Reverse charge Mechanism @ 12.36%
RCM is applical for the company.. The company have to pay 12.36% on 20,000/-
They can avail input tax credit on the same..
