Reversal of excise duty paid

We as manufacturer stock transfer goods produced to another branch other than the manufacturing location. Excise duty paid invoices are issued for the same. Ninety containers of one product were invoiced during December 2014 after stuffing but goods could not be cleared fully. Eighty containers were stock transferred during first week of Jan 2015. It may please be noted that one invoice was generated against each container stuffed.

We intend to cancel the invoices for material stuffed in ten containers and thereby avail the refund of excise duty paid (as per duty paid invoices). How do we proceed(specially invoices were generated in Dec 14 whereas cancellations as intended are to be effected in Jan 15)? Please guide.

Duty paid goods have to be back into the factory following rule 16 of the C.EX. Rules. You can take cenvat credit equivalent to the duty paid.You have not to apply for refund.
