yes if ur supplier fails to do so u will have to suffer so always purchase from those who regularly make compliance

As per Sec 16(2)(c), No registered person shall be entitled to the credit of any input tax in respect of any supply of goods/services to
him unless the tax charged in respect of such
supply has been actually paid to the Government.

So, if your supplier dont pay his taxes, you are not entitled for ITC.
