Please Help me on following:
My family member wishes to get registered with Service tax Deptt.
The office staff in Lucknow is insisting to provide an undertaking that we shall bebound to levy service tax from day 01 after registration.
I feel we have right to get registered and afterexhausting the exempted limit of 08 lakhs , we need to charge the stax and depsoit with stax deptt.
Can They refuse registeration without nay affidvait ? If not pl provide the solution
There is no undertaking required under law. Further you can claim the exemption upto Rs.10 Lakhs and then start payment of ST. You are entitled to get a registration certificate anyway. You would however be required to file your returns thereafter.
Please mark a letter of complaint ot the higher officer preferably the comm of ST or Chief Comm of central excise.
