As per law it is not possible, but practically we do that. I claimed refund in many cases declaring the last year income in current year and take TDS credit in current year.
This is only my personal opinion from what I did and claim refund. Also the 4 years elapsed in the case where I did it, so it is also clear that no objection raised by CPC.
