RE-SELLING OF REJECTED DUTY PAID GOODS

Dear All,

We are manufacturer of Iron & Steel Products. some time the material sold by us rejected by the buyer. At that time, can we divert the same to anther customer?(to avoid freight charges from their to our factory) if yes can any body explain the procedures to be followed under Central Excise Act/Rule.

you can't divert to another buyer.

Sale in transit is a well known concept in commercial law. There is no bar in selling the goods to the another customer, the question is how will cenvat credit be transferred to the new buyer?

Presently there is no such provision in Central Excise Law.
