Query Form 15CA and Form 15CB

i am non resident of india. purchased a residential flat in india in FY 2017-18 and sold in FY 2019-20. Funds from sale consideration are in my NRO account and I want to move funds in my NRE account. Sale consideration is 56 lakhs.
please specify which part of Form 15CA to be filed and Form 15CB ??

You should mention the details under section B under the head " Remittance" of form 15CA and 15CB

I think you should fill 15CB and upload. 15CA will then be generated.

In this case, as the funds from the sale of property are in your NRO account, and you are now looking to transfer the funds to your NRE account, the following applies:

  1. Form 15CA Part C should be filed since the sale proceeds are above ₹5 lakh, and it involves a transfer from your NRO account to your NRE account. Part C is applicable when tax is payable on the remittance, or TDS has been deducted at source on the sale of property.

  2. Form 15CB should be obtained from your Chartered Accountant (CA). The CA will verify and certify the TDS deduction on capital gains (if applicable), as per Section 195, and provide the required details for Form 15CA.

  • Part C of Form 15CA will include the details of the remittance and confirm the TDS details.

  • Form 15CB will certify the TDS deduction under Section 195 and provide confirmation that the correct tax has been paid.
