Purchase of basement parking

Dear sir

I have been living in an apartment complex since 2003 which got it s occupation certificate in 2002 itself. However, i never bought a basement parking ever . I am buying one now and the builder is charging me 18% GST on it.I had an arguement with the builder saying that GST cannot be charged on the sale of the parking as the building is not under construction and the building has an OC and the basement parking forms part of the building only.

So, will the GST be 18%, 12% or nil and why?

As the apartment is already occupied by residents, means the completion certificate is already obtained. No GST applicable on any of the sell of units in the building, as GST is applicable only on under-construction properties.

Prima facie, builders are not allowed to sell open space or basement of any building; as per court rulings the space is the property of society !!!

After BU permission builder will collect only part payment which is collected before BU... N after BU permission u can not pay any gst on property..

'Building Use permission' isued by some Municipalities....... equivalant to 'Completion certificate' or 'Occupation Certificate' by many other corporations......
