Labour & Industrial 1309 views 4 replies

Dear All,

Please let me know what should an employee should do to withdraw his PF Amount from the authorities if the Employer is not ready to certify the Prescribed Forms.

I had served the company for 5 Year and now the employer is not ready to sign the form which I required to submit for the PF Withdrawal.

Thanks

As of now there is no possibility of getting directly from EPFO .

However, employer cannot with hold the application unduly long time in prescribed form for settlement .

This is required since employer has to give all the details of remittances made to EPFO during the current  PF year(March to Feb) along with details of Annual PF Statement of the last year handing over to the PF subscriber (you).

Safe side you can send a second copy of replica of the claim made to employer to RPFC office of your jurisdiction.

Now a days even if the remittances are not made by the employer promptly RPFC is supposed to settle the claims.

Your next complaint can be to RPFC office of your area and then to CPFC office of India and Ministry of Labour,GOI.

Thank you Sir for your reply.

I was advised by few of my colleagues that I should get the forms verified by the bank where I own my account and than should deposit the same in the PF office. The PF Officer than will himself get it certify from the employer.

Though it may not be the procedure nothing wrong in doing so ,some times it may help.
