For Income Deemed to Accrue or Arise in India-Section 9

1) Any Income from Salary if it is payable for service rendered in India.

If A is an employee of B in U.S.A . B sends A to India for 10 days for some work.So He will be considered as Non- Resident, so A's salary for 10 days will be taxable in India??

Like his salary is 60000 (whatever the currency) per month , so his salary for 10 days would be 20000 then he will have to pay tax on 20000 ? ?

Sec 9(1)(ii)- Income chargeable 2 tax under the head "Salaries" is deemed to accrue or arise in India if it is earned in India and payable for service rendered in India .

it is Indian Income. So it is taxable both in the hands of Resident as well as nonresident

even if this is the first he's been visiting to India ??

what if he's not having any pan card or any identity?

i think in this case the person who is paying the income is liable to deduct the tax at source.

In that case, those details are not necessary

1. It does not make any difference.

2. The said amount will be taxable in India but it will be guided by the taxation laws prevailing in India. So if the sum is Rs. 20,000/- the same is not liable to pay tax as it is below the basic exemption. If it crosses the basic exemption then he will be liable to pay tax.

okk.. thanx all for the help.. now i m clear with it!!

thanx a lot!
