Sir,

I would like to know the gratuity Eliglibity ofthe employee ( in administration) when the comany is winding up the business, provide me details of calculation  of the gratuity and calculation method

1.Gratuity Shall be Payable to an Employee On His Termination Of His Employment After He Has Rendered Continuous Service of Five Years 

A)Provided that the completetion of continous service of five years shall not be necessary where the termination of the employment of any employee is due to death or disablement 

B)Provided That In Case Of Piece Rated employee daily wages shall be computed on the average of the Total wages received by him for the period 

 

2. Gratuity = (Last drawn (Basic+DA) / 26) x 15 x Number of years of service
