As per the Provision of Section 96 of the Companies Act 2013, AGM should be held within earliest of the following :

a). within 6 months from the end of FY; or
b). 15 months from the last AGM.

Notice u/s 101 of the Companies Act 2013 of the AGM need to be circulated to all the members, auditors and Directors in 21 days clear Notice.

As per the provisions of section 101 of the Companies Act 2013, notice of AGM shall be issued at least 21 days before the date of Annual General meeting which shall exclude the date of AGM on which the meeting is held and the date on which notice is send. Further, in case notice is being sent through speed post, extra 2 days shall be allowed for sending the Notice of AGM.

If the notice is going to be delivered through electronic mode (like Email, file transfers) or to be delivered directly then notice to be issued 21 days in Advance (not counting the AGM date). If it is delivered in post than 24 days from AGM.

For private companies the AGM can be called even immediately on anytime during the month of Sep by issuing shorter notice. Provided 95% of Share holders Agree.
