Gujarat High Court Accept the Petition on Section 39 for claiming ITC.
All taxpayers are advised to not to reverse there ITC on account of Mismated if they have proper Invoice and timely payment proof. It is our constitutional rights under article 14 to upload invoices in GSTR-2

Sir, what if buyer claimed ITC on those bills which the supplier showed as B2C invoice ??
The law may support the recipient who has received the goods or services and paid the value & tax. Court would support. However supplier can be asked to rectify the b2c invoice to b2b as policy where amount sare larger.

please quote the order. name of the assessee, court and date of decision.. this will be very helpful to fight the GST Department for their unholy approach. regarding GSTR 2A is not having any impact over GSTR 3B
