Minimum Employees for ESI

The Act extends to the whole of India. It applies to all factories (including Government factories but excluding seasonal factories) employing 10 or more persons and carrying on a manufacturing process with the aid of power or employing 20 or more persons and carrying on a manufacturing process without the aid of power and such other establishments as the Government may specify.

A factory or other establishment to which this Act applies, shall continue to be governed by its provisions even if the number of workers employed therein falls below the specified limit or the manufacturing process therein ceases to be carried on with the aid of power, subsequently..

If in any company, There is 25 Employees out of only 10 are drawing wages upto Rs.10,000.00 p.m.,(Limit for ESI applicabilty) will ESI Act be applicable in that case? Employee means any employee or employee drawing wage under ESI eligibilty limit (Now Rs.10,000.00)? In past I raised query on this and got mixed reply? Please confirm.

Good question...

When tha act sets limit of 10 or 20 employees for ESI registration..it doesn't mean that all 10 or 20 employees are eligible....its just the limit for ESI registration...in the example quoted by u..only 10 employees mentioned by u may be eligible..

What about the eligibility of a trading company? What is the meaning or limit of the term power used in the " employing 10 or more persons and carrying on a manufacturing process with the aid of power or employing 20 or more persons and carrying on a manufacturing process without the aid of power". It is  alternate power or the usual power? Comsumption limit in H.P?

 

Limit for no. of employees is to be check only for employees who fulfill the critaria which is now 15,000 please check th link below. If u see the defination of Employee it will excludes the persons earning salary above 15,000. https://esicmaharashtra.gov.in/htmldocs/def_employee.htm

can  anyone help me.

if we have 2 companies under registered shop and estblishment 

having employee more then 20 in both 

more then 11 having salary avobe 15000 so could be registerd the ESI & EPF 

because most of employee do not want to dedust ESIC and EPF so we want to fill form-11 for not deduct pf etc 

so remain employee same donot want to deduct pf and esic so is their any possibility for us 

that if we donot empliment esic and pf in our organization 

we are just IT company develop application

Hi software making office mainly getting work done by outsource persons, is covered under ESI?

 

It covers factory only or office too? Officers are harassing every now and then to look spyingly in vouchers as if we are thieves and asking bribe. our physical employment is hardly 2 persons on site. we have 15 employees on board but 13 are off the office. can we do something with them to take up?

@ some legal expert: please help
