company is liable to pay service tax, RCM applicable, but quantam of ST payable is not to be deucted from bills, as ST is additional tax above the service
example
a registered service provider bill
service offered ...............100000
Service tax ......................12500
total bill ..........................112500
receiving company will avail input credit of 12500 ST on above bill
a non regd service provider bill
service offered ..............100000
Service Tax ....................NIL
Total bill ........................100000
receiving company will pay service tax and would be in position to avail input credit of same
