Can anyone tell me is there any act that forbids a wife from filing a maintenance petition either under section 125 of Cr.p.C or under personal law if the husband is dwelling in a foriegn country?

Hi Mr.Rama Krishnan,

I donot think so. However, there are some exceptions for maintenance. If the wife is having sufficient income on her own for maintenance or if the divorced wife got remarried, in such cases, wife is not eligible for maintenance petition. In case of Muslim women, husband is generally liable for maintenance for the IDDAT period only (3 months or 3 mensural cycles). thanks & regards: Saida
