ITR form for govt school contract teacher salary TDS deducted us 194J

Hi,  can someone  please help on which ITR form to fill if income is in nature of salary of contract teacher in delhi govt school and tds is deducted u/s 194J.  No form 16 or 16A has been issued.  Can itr1 be filed with income shown under income from other sources?

No, you can not file ITR 1

you can file ITR 3
Itr3 or itr4
as proffestional fees
If tax is deducted under section 194J then your income will fall under income from professon (PGBP).So it is not salary hence ITR-1 is not applicable.

You may file ITR-3 if you don't opt of 44ADA.
ITR-4 if you opt for presumptive taxation under 44ADA

That is fundamentally wrong on the part of many schools that they are deducting tax u/s 194J for payments to contract teachers.

Tax deduction section won't determine the nature of payment. Here, the remuneration is salaries.

You should better file ITR-1 with showing it under income from salaries.

About form 16A, you can check 26AS. If every amount is mentioned in it, it would be sufficient for filing. But you should demand for form 16A.

But here's the salary is of section 194j and 192 as per salary if he filed as per 192 itr1 then he gets notice

Hence till they complaint and make the system of school perfect I don't think they should file itr1

Personal opinion

Myself filling itr1 for contract lecture /teacher when there salary as per 192

 

I have filed ITR1 and shown earnings under income from other sources 

File aimpy itr 1
