Is there any penalty on re downloading form 16a

Hi,

I have a small business and I had downloaded the Form 16A on time within 15 days of furnishing the return. I still have all the downloaded form 16a with date on which they were downloaded.

But my accountant lost all the physical copies of the form and instead of asking me for the digital versions he downloaded the form 16a from TRACES website from FY 2013-2014.

My CA is saying that this will attract a penalty of Rs 100 from 2013-2014 per return since FY 2013-2014. Is this true. Even if I show back dated form 16a still will a penalty be imposed.

Please help I am very anxious as a very hefty amount will have to be paid if this happens.

Edit : we have paid the TDS on time and the deductees have deducted the same.

Hello Madhav,

IT act clearly states that, "Failure to furnish Certificate of Tax deducted at source within 15 days from due date of furnishing the TDS statement attracts Penalty amounting to Rs. 100 per day of delay"

Since you had already furnished the Certificate, and it was just a re download, it won't attract Penalty

What does the word "furnish" imply does it mean download or does it mean furnished to the deductee. Will the assessing officer consider soft copies (from TRACES website) as proof of download.

Will assessing officer consider soft copies as download. What does "furnished" mean in the act does it mean furnished to deductee or downloaded.

Furnished means furnished to the deductee
