Is service tax refundable?

Hi,
I had booked a flat on ground floor in a building in a society. The flat had some open paved area. I had paid service tax for this area at the rate of 3.09%. At the time of possession, the builder decided to take back a part of the paved area and refund the amount. But the refund amount given to me does not contain the service tax amount that was paid by me at the time of allotment. 
The builder says that service tax is not refundable. Is this correct?

Service tax is not refundable in general but in case service is not rendered eventually one can file refund claim and get refund. It may be noted that getting refund of service tax is not as easy as income tax. So you may ask your builder to take adjustment of service tax on ur part of refund against his another liability under rule 6. And then refund the tax amount to you.
